One of the Hastie stable members, Graeme Dalgleish, is about to commence a major equal pay challenge against Glasgow City Council on behalf of a number of union backed claimants. Along with other large groups of claimants, the challenge, known as the second wave challenge, is to the validity and reliability of the council's job evaluation scheme under section 1(5) and 2A(2A) of the Equal Pay Act 1970 (now superseded in its entirety by the Equality Act 2010). It is scheduled to run for six weeks in Glasgow.
Meantime, the recent successful equal pay challenge to the South Lanarkshire Council job evaluation scheme is now subject to appeal to the Employment Appeal Tribunal. The result is likely to be of interest to employment law practitioners with an interest in equality and discrimination issues.
